LAW AS PHILOSOPHY: A HARMONY BETWEEN LAW AND MUSIC

Abstract

Law, like music, is an art of balance and order, a subtle form of organizing diversity into harmony. We will try to exploit, in a multidisciplinary manner, the way in which philosophers and theorists have seen law not just as a set of abstract rules, but as an organic system, capable of regulating social interactions in a manner comparable to the way music harmonizes sounds, rhythms or timbres.Like musical harmony, law operates on the principle of proportion and balance, seeking to maintain coherence and justice between individual interests and the collective good. Just as in musical polyphony several voices retain their individuality, but contribute to a greater unity, legal pluralism allows the coexistence of several value systems and norms, without subordinating them to a rigid hierarchy. The rhythm of music, which dictates the fluidity and coherence of a composition, reflects the role of legal norms in structuring social behaviors and ensuring continuity and stability. At the same time, the aesthetics of law, like that of music, is not limited to functionality, but also reaches an intellectual and emotional dimension, offering a satisfaction that comes from the inner harmony of a well-constructed (legal) system.
